What Is a Digital Signature Certificate (DSC)?

A Digital Signature Certificate (DSC) is an electronic credential issued by a government-licensed Certifying Authority (CA) that uniquely identifies the holder and is used to sign digital documents electronically. In India, DSCs are issued under the Information Technology Act, 2000 and are legally equivalent to a physical signature on a paper document.

DSCs are now mandatory or heavily preferred for a wide range of legal, financial, and government processes in India - including company incorporation and annual filings with the Ministry of Corporate Affairs (MCA), income tax return filing, RERA applications, government e-tendering, EPF and ESI filings, and various court-related digital processes.

DSCs are stored on a USB token (hardware security module) or can be cloud-based, and are protected by a PIN. They cannot be forged, replicated or misused without physical access to the token and the PIN.

When Do You Need a Digital Signature in Pondicherry?

  • MCA / ROC Filings - All forms filed with the Ministry of Corporate Affairs (MCA21 portal) require DSC of directors, company secretaries and CA/CS/CMA. This includes SPICe+ (company incorporation), AOC-4 (annual accounts), MGT-7 (annual return), and change of directors.
  • Income Tax e-Filing - While most individual ITR filings use OTP-based verification, companies and LLPs must file using DSC. E-assessment proceedings and responses to IT notices may also require DSC.
  • RERA Applications - Registration of real estate projects and agents with Puducherry RERA requires digital signatures of promoters and agents.
  • Government e-Tenders - All government procurement tenders on platforms like GeM (Government e-Marketplace), CPPP, and state portals require DSC for bid submission.

Classes of DSC Available

  • Class 3 DSC (Individual) - Highest security level. Required for MCA filings, e-tendering, income tax (companies), RERA. Issued after KYC verification. Valid for 1 or 2 years.
  • Class 3 DSC (Organisation) - For entities (companies, LLPs, firms) - includes organisation name along with individual signatory details. Required for company filings under MCA.
  • DGFT DSC - Specifically for Directorate General of Foreign Trade (DGFT) portal for import-export related filings and IECF applications.

A digital signature (DSC) uses Public Key Infrastructure (PKI) cryptography - it is mathematically linked to the document content and the signer's unique certificate, making it tamper-evident and non-repudiable. An electronic signature (e-sign) is a broader term that includes typed names, scanned signatures, and Aadhaar OTP-based signatures. DSCs provide the highest level of legal security. For MCA, income tax (companies) and e-tendering, a DSC is specifically required, not just any e-signature.

With Aadhaar-based video KYC, a Class 3 DSC can typically be issued within 1 to 3 working days after successful KYC verification. The process involves an online video call with the Certifying Authority's representative for identity verification. With physical verification at a Registration Authority (RA) office, it may take slightly longer. We assist with all the steps to ensure the fastest possible issuance.

DSCs are typically valid for 1 year or 2 years from the date of issuance, depending on the package chosen at the time of application. Before expiry, the DSC must be renewed by applying for a fresh certificate. We can alert you before your DSC expires and assist with renewal.

A DSC stored on a USB token is physically portable - you carry the token and the PIN. However, sharing your DSC with others is a serious security risk and is legally problematic - the signature on any document will legally bind you, and misuse of a DSC is an offence under the IT Act. Always keep your USB token and PIN secure and never share them.
