Patent Filing Process in India
Inventor discloses the invention to our patent attorney — working principle, technical novelty, advantages over existing solutions and commercial application.
Conduct a thorough prior art search in the Indian Patent Office database, global databases (USPTO, EPO, WIPO) and scientific literature to assess novelty and patentability.
Draft the patent specification — title, field of invention, background, detailed description, claims (independent and dependent) and abstract. Claims define the legal scope of protection.
File the application at the Chennai Patent Office (jurisdiction for Tamil Nadu and Pondicherry) with Forms 1, 2, 5 and drawings. Pay government filing fees.
Patent published 18 months from filing date. File Request for Examination (Form 18). Examiner issues First Examination Report — respond to objections within 12 months.
Patent granted after examination objections are resolved. Patent protected for 20 years from filing date, subject to annual renewal fees (starting 3rd year).
